Terms of service
These Terms of Service (the "Terms") govern your use of Studios by Xenyyo (the "Service"), operated by Xenyyo Inc., 24529 2nd St, Hayward, CA 94541, United States ("Xenyyo", "we"). By creating a site with the Service or using it, you accept these Terms on your own behalf or on behalf of the studio you represent ("you", the "Studio").

1. What the Service is
Studios by Xenyyo delivers and hosts a website for your creative studio: class pages, online sign-up, payments through Stripe, email confirmations and reminders, and a dashboard to manage sign-ups and students. Your site lives on a studios.xenyyo.com subdomain or on your own domain.
2. Who can use the Service
The Service is for studios, workshops and individuals who teach classes or courses. By accepting these Terms you confirm that you are of legal age, that you have authority to bind the Studio, and that you are using the Service for your business and not as a consumer.
3. Your account
You are responsible for keeping your account secure and for everything done with it. Tell us right away at support@xenyyo.com if you think someone else is using it.
4. Your content and your students
The content on your site (name, logo, photos, descriptions, prices, policies) is yours. You give us permission to host, display and process it only to provide the Service. You are responsible for owning or having the right to use that content, for keeping your class information accurate, and for delivering what you offer your students. Dates, spots, refunds and cancellations are between you and your students and follow the policies you publish on your site.
We process your students' data on your behalf and under our Privacy Policy. Toward them, you are the responsible party.
5. Payments and Stripe
Payments from your students are processed by Stripe through a Stripe account in your name, subject to Stripe's terms. Your sign-up revenue goes to that account; Xenyyo does not receive or hold it. Stripe fees, chargebacks and disputes with your students are yours.
6. Price of the Service
During the pilot period the Service is free. Before we start charging, we will give you at least 30 days' written notice of the price or fee, and you may end the Service without penalty if you don't agree.
7. Your own domain
If your site uses a domain registered through Xenyyo, the domain is yours. Xenyyo manages it while you use the Service. If you end the Service, we will transfer it to you at no extra cost within 30 days of your request, subject to lock periods imposed by registrars (for example, 60 days after a recent purchase or transfer). Annual renewals are billed separately. If you use a domain you already owned, nothing changes: you simply point it to our service.
8. Email
The Service sends email to your students on your studio's behalf (confirmations, reminders, notices). We will not use your student list for our own purposes or for third-party advertising.
9. Acceptable use
You may not use the Service for unlawful activity, to sell anything other than classes, courses or experiences taught by you in person or online, to send unsolicited email, or for content that infringes third-party rights. We may suspend a site that violates this, with notice to you unless there is a risk to others.
10. Availability and changes
We make reasonable efforts to keep the Service running, but we do not guarantee uninterrupted availability. We may improve, change or retire features; if a change materially reduces what you have today, we will tell you in advance.
11. Intellectual property
The Service, its code, templates and trademarks belong to Xenyyo. You receive a license to use them while you use the Service. Studio sites display a discreet "Site made with Studios by Xenyyo" notice. Intellectual property and DMCA notices: dmca@xenyyo.com.
12. Termination
You may end the Service at any time by writing to support@xenyyo.com. When you do, we give you your students and sign-ups as a CSV file, take your site offline and, if applicable, start the transfer of your domain. Your Stripe account remains yours. We keep data for the period stated in the Privacy Policy and then delete it.
We may end the Service with 30 days' notice, or immediately if you seriously breach these Terms.
13. Liability
The Service is provided "as is". To the extent permitted by law, Xenyyo is not liable for indirect losses, lost profits, or anything that happens between you and your students. Our total liability to you is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
14. Governing law
These Terms are governed by the laws of the State of California, United States. Any dispute will be resolved in the courts of Alameda County, California, after we first try in good faith to resolve it by email.
15. Changes to these Terms
We may update these Terms. We will post the new version with its date and, for material changes, notify you by email 30 days in advance. Continuing to use the Service after that date means you accept the new version.
